International arbitration is considered the optimal way to address and resolve such disputes between parties. It modifies the dispute, assures neutrality in adjudicating the dispute, and is perceived as an economical, speedy, and flexible procedure. And based around this was the theme of Construction Week’s Dispute Resolution Question Time Dubai conference, which was held on 6 October 2021 at Grosvenor House Dubai. The conference was organised alongside our event partners, Reed Smith and Driver Trett. How is international arbitration becoming a preferred method of dispute resolution, especially in the UAE? We found the answers to this question and more in our panel discussion moderated by Construction Week’s Editor Ranju Warrier. The panel was headlined by Phil Duggan, Head of Expert Services – Middle East at Driver Trett; Rachel Larkin, Legal Director at Reed Smith; and Mark Raymont, Partner at Pinsent Masons. Duggan is a quantity surveyor with over 25 years of experience in the construction and engineering industries and has experience across many sectors of the construction industry, including power generation, water and sewage treatment, and petrochemicals, to name a few. Meanwhile, Raymont is a Solicitor of the Supreme Court of England & Wales and has been admitted as a Solicitor of the High Court of Hong Kong. He has nearly 30 years of experience advising a wide range of clients across various sectors, including construction and engineering. The discussion started with a key question: Why has international arbitration become a preferred method of dispute resolution? In response to this, Raymont said: “Arbitration offers opportunity in terms of dispute resolution, and that is why people choose that route as the better alternative.” Meanwhile, Duggan exclaimed: “In the Middle East it brings a better outcome and a better quality of expertise across the region. I am looking forward to international arbitration as it gives you a better chance to make the right decision.” The use of international arbitration has evolved to allow parties from different legal, linguistic, and cultural backgrounds to resolve their disputes. Panellists shared their view on the reasons behind international arbitration being considered better than going to courts in Abu Dhabi or Dubai where the documentation process is often in Arabic, but most construction contracts are in English. “The client team and management team would be a lot more comfortable in conducting procedures and disputes in a language they understand,” Raymont stressed. Echoing Raymont’s comments, fellow panellist Larkin said: “Any form of dispute resolution requires a massive amount of translation. The translation costs are immense.” On his part, Duggan said: “When you have written a technical report which was translated in Arabic, you are limited to understanding whether the technical translations were done properly. In my experience, they weren’t fully-equipped to take on the matter.” Earlier this year in September, HH Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE, and the Ruler of Dubai brought together the emirate’s three main arbitration institutions, giving a complete overhaul to Dubai’s arbitration system. Commenting on the developments and its impact on the future of arbitration, Larkin said: “I think, generally speaking, it’s a bit premature. It could be that Dubai seizes an opportunity to create a truly dynamic arbitration institute as well.” Meanwhile, sharing his thoughts on whether Abu Dhabi has become an attractive arbitration venue compared to Dubai, Duggan noted: “Abu Dhabi was always an attractive location for dispute resolution.” On a concluding note, panellists agreed that the nature of international arbitration has strengthened its position as a reliable dispute resolution mechanism in the UAE.
